Breakfast: Breakfast is not included in the room rate.

Reservation: In order to confirm your booking, a credit card number will be asked. Except in case of late cancellation, the credit card won’t be debited. The balance of your stay is payable on site.

Cancellation: You can cancel for free your booking until 8 days before the arrival date. If you cancel your booking from 7 days before the arrival date, the full amount of the stay will be charged.

Accessibility: Our establishment does not have refitted room.

Sanitary measures: We respect the security and disinfection protocols so that you can have a nice and peaceful summer.

INFORMATION ON THE PROCESSING OF PERSONAL DATA

Hotel Cap Soleil, with registered office at 24 rue de la Baie 83240, Cavalaire sur Mer, France as data controller, informs you in accordance with art. 13 of Legislative Decree no. 196 of 30.6.2003 (hereinafter, the “Privacy Code”) and art. 13 of EU Regulation no. 2016/679 (hereinafter, the “GDPR”), that your data will be processed in the following ways and for the following purposes:

1. Purpose of the Processing

The Responsible Entity processes personal, identifying data (e.g. name, surname, company name, address, telephone, e-mail, bank and payment details) – hereinafter, the “personal data” or also the “data”), which you have provided when concluding contracts for the services of the Responsible Entity.

2. Purposes of the processing

Your personal data will be processed only with your specific and separate consent (art. 23 and 130 of the Privacy Code and art. 7 of the GDPR), for the following marketing purposes:

– booking and managing your reservation
– to send you by e-mail, mail and/or sms and/or telephone contacts, newsletters, commercial communications and/or advertising material on the products or services offered by the Manager and the statement of the degree of satisfaction on the quality of the services.

3. Methods of processing

The processing of your personal data is carried out by means of the operations indicated in art. 4 of the Privacy Code and art. 4, no. 2), of the RGPD, and in particular: collection, recording, organisation, conservation, consultation, processing, modification, selection, extraction, reconciliation, use, interconnection, blocking, communication, erasure and destruction of data. Your personal data is processed both on paper and electronically and/or automatically.

The Manager will process personal data for the time necessary to fulfil the above-mentioned purposes and for a maximum of 10 years after the termination of the relationship for Service Purposes and for a maximum of 2 years after the collection of data for Marketing Purposes.

4. Access to data

Your data may be made accessible for the following purposes

– to employees and collaborators of the Responsible Entity or companies in their capacity as processing personnel and/or internal processors and/or system administrators.

5. Disclosure of data

Your data will not be disclosed.

6. Transfer of data

Personal data is stored on servers located in the European Union. In any case, it is understood that the Responsible Party, if necessary, will have the right to move the servers even outside the EU. In this case, the Responsible Entity already guarantees that the transfer of data outside the EU will take place in compliance with the applicable legal provisions, subject to the stipulation of the standard contractual clauses provided by the European Commission.

7. Nature of data provision and consequences of refusal to respond

The provision of data for the purposes specified is mandatory. If you do not provide the data, we will not be able to provide you with the Services.

The provision of data for the purposes in question is, however, optional. You may therefore decide not to provide any data or to subsequently refuse the possibility of processing the data already provided: in this case, you will not be able to receive newsletters, commercial communications and advertising material concerning the Services offered by the Manager. In any case, you will continue to be entitled to the Services.

8. Rights of the data subject

As a data subject, you have the rights referred to in art. 7 of the Privacy Code and art. 15 of the GDPR, and more specifically the rights to:

i. obtain confirmation of the existence or otherwise of personal data concerning you, even if not yet recorded, and their communication in an intelligible form.

ii. to obtain the indication of: a) the origin of the personal data; b) the purposes and methods of the processing; c) the logic applied in the case of processing carried out with the help of electronic instruments; d) the identification data of the person in charge, of the processors and of the representative appointed in accordance with art. 5, paragraph 2, of the Privacy Code and Art. 3, paragraph 1, of the GDPR; e) the persons or categories of persons to whom the personal data may be communicated or who may become aware of it in their capacity as designated representative in the territory of the State, processors or staff in charge;

iii. obtain : a) the updating, rectification or, where appropriate, integration of data; b) the erasure, anonymisation or blocking of data processed in breach of the law, including data whose retention is unnecessary for the purposes for which they were collected or subsequently processed; c) certification that the operations referred to in a) and b) have been brought to the attention, also with regard to their content, of those to whom the data have been communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right to be protected;

iv. to object, in whole or in part: a) on legitimate grounds, to the processing of your personal data, even if relevant to the purpose of collection; b) to the processing of your personal data for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication, using automated calling systems without the intervention of an operator, by e-mail and/or traditional marketing methods by telephone and/or mail. Please note that the data subject’s right to object, as set out in point b) above, to direct marketing by automated means extends to traditional means and that there is still the possibility for the data subject to exercise the right to object even if only in part. Therefore, the data subject may choose to receive only communications by traditional means or only automated communications or neither.

Where applicable, he or she also has the rights provided for in Articles 16-21 of the GDPR (right of rectification, right to be forgotten, right to restrict processing, right to data portability, right to object), as well as the right to lodge a complaint with the Control Authority.
